Privacy Policy

GM3 respects your privacy and is committed to complying with the Privacy Act 1988 (Cth).

This Privacy Policy outlines how GM3 handles personal information related to individuals that interact with GM3. It also describes, generally, the sorts of personal information GM3 holds, for what purposes, and how that information is collected, held, used and disclosed.

For the purposes of this policy:

Personal Information is information about, or an opinion about, an individual whose identity is apparent or can be reasonably ascertained.

Sensitive Personal Information is a subset of Personal Information and includes information, or an opinion, about your:

Whose Personal Information do we collect?

GM3 collects Personal Information during its business interactions.

GM3 may, depending on how you interact with GM3, collect Personal Information from customers, contractors, suppliers, employees, job applicants, landowners, community organisations, shareholders and visitors to our offices, sites and website.

What Personal Information do we collect?

The types of Personal Information GM3 may collect from time to time include:

  • personal information about you, such as your name, address, gender, date of birth and contact details.
  • recruitment-related information such as your employment status and history, education status, personal interests, types of roles you are interested in, and your resume. In the event you progress through the interview process, GM3 may also collect other information such as interview notes, referee reports, health or medical information, results of any psychometric tests and background checks (including criminal records checks), your work visa and other information to verify your identity and your right to work.
  • electronic information (for example) required to provide access to GM3 websites or portals (such as login information, IP addresses), and records of your use of those websites or portals.
  • usage information when you use our websites, such as server log information (your IP address, browser type, operating system, browser language, time zone, access times and any referring addresses) and location information.
  • other information such as information about access and attendance to GM3 premises and physical assets (such as security records about times of entry and exit, and information collected through CCTV), details about your use of our assets, communications with you (including complaints or concerns raised by you or any feedback or survey responses that you provide to us) and other information you voluntarily provide to GM3.
Why do we collect Personal Information?

GM3 only collects information about you that is reasonably necessary for GM3 to undertake functions and activities.

The purposes for which GM3 will process your Personal information will depend on the type of Personal Information collected and the context in which it was collected. Nonetheless, the main reasons why GM3 process Personal Information include:

  • managing our business relationship with you – this includes providing you with information or services, improving our products and services and communicating with you;
  • business-related purposes such as negotiating, managing, and fulfilling our contracts with customers, suppliers and third parties, managing business relationships, conducting clearance procedures, managing accounts and records, supporting corporate social responsibility activities, resource planning and workforce management, and internal investigations;
  • marketing and public relation purposes for example to personalise your experience on our website;
  • recruitment-related purposes – this includes considering you for career opportunities (including training positions) with GM3 and inviting you to participate in recruitment activities and events;
  • managing safety and security risks – this includes managing and monitoring access and use of our premises and sites, safety and security at our sites, and our IT environment and the health of those on our sites;
  • website administration and internal operations which includes troubleshooting, data analysis, testing, research, statistical and survey purposes; and
  • meeting legal obligations imposed under law, responding to lawful requests from regulatory and public authorities and responding to potential or actual litigation.
Who we may share your Personal Information with

GM3 may share Personal Information internally within GM3 but may also need to share your Personal Information (which may sometimes include Sensitive Personal Information) with:

  • people you have authorised to interact with us on your behalf (for instance recruitment agencies);
  • third parties who provide services we use to run our business (such as external service providers that assist GM3 to perform HR, information technology and other shared services functions, that provide IT services or that provide security for GM3 sites or systems);
  • our professional advisors (such as our lawyers and accountants); and
  • government authorities or other persons where obliged to do so by an applicable law.
How do we store and protect your Personal Information?

GM3 will take reasonable steps to ensure that your Personal Information is always kept protected and secured against unauthorised access, modification or use.

GM3 will only keep your Personal Information for as long as GM3 needs it to carry out the purposes described in this Privacy Policy and will take reasonable steps to destroy or permanently de-identify it when GM3 no longer needs it.

That said, when using our website, you should be aware that no data transmission over the internet can be guaranteed as totally secure. Although we seek to protect such information, we do not warrant the security of any Personal Information that you transmit to us over the internet, and you do so at your own risk.

What are your rights to access to your Personal Information?

As an individual, you have the right to:

  • know what Personal Information is being collected from you,
  • know why your Personal Information is being collected, how it will be used and who it will be disclosed to,
  • ask for access to your Personal Information (including your health information),
  • stop receiving unwanted direct marketing, and
  • ask for your Personal Information that is incorrect, to be corrected.

Under certain circumstances, GM3 may not be able to provide you access to your Personal Information. For example, if providing access would be unlawful or providing access would have an unreasonable impact upon the privacy of other individuals. We will give you reasons if we deny you access to your Personal Information.

How to make a complaint?

If you have a complaint about GM3’s handling of your Personal Information, including your request for access or correction of your Personal Information, please contact us via email to gm3legal@gm-3.com.au and we will aim to resolve your complaint.

If we do not resolve your complaint to your satisfaction, you may complain to the Office of the Australian Information Commissioner.

Update to this Policy

GM3 may modify or update its Privacy Policy from time to time where necessary to reflect changes in applicable laws or in our privacy compliance practices.
